<p>The facts leading to this case are that the complainant in this matter met with the accused from grazing and asked the accused whether he wanted to buy his bull on grounds that he urgently wanted money for purposes of satisfying his child’s school fee needs and both settled at a consideration of Kenya shillings 35,000/=. The accused and the complainant agreed that the accused could pick the bull without paying and further that payment should be made after the accused has disposed the subject bull by sale. The accused alleges that he had paid the complainant some 12,000/= which the complainant disputed and upon the Assistant chief attempts to settle this matter out of court, the assistant chief asked the accused to pay the complainant a consideration of Kshs. 32,500/= albeit without justifiable reasons.</p>
