<p>Indeed, abolitionism appeared to have a viable path to victory. In addition to Breyer, Justice Ruth Bader Ginsburg was also on board; in fact, she joined Breyer&rsquo;s dissent. That meant only three more votes would be needed, two of which could come from Justices Elena Kagan and Sonia Sotomayor. That left one more vote to secure. Despite Hillary Clinton&rsquo;s qualified support for capital punishment &mdash; her position is anti-federalist in that while she thinks the federal government should continue to have recourse to it, she doesn&rsquo;t think states should be applying it &mdash; I expected her to&hellip;ahem&hellip;<em>adjust</em>&nbsp;her position in the face of ever-declining support for it (even&nbsp;<a href="http://www.people-press.org/2015/04/16/less-support-for-death-penalty-especially-among-democrats/" rel="noopener ugc nofollow" target="_blank">among Republicans</a>).
