SCOTUS Wars Against the Disabled
<p>Congress enacted statutes prohibiting recipients of federal funds from discriminating on the basis of certain <em>protected characteristics</em> — one such characteristic<em> </em>is <em>disability</em>. The Supreme Court agreed there is a right to sue in the event of discrimination, but took away the the traditional remedy — emotional suffering damages! With a little slight-of-hand magic the Supreme Court trimmed down the protection of civil rights and civil liberties of disabled people that will also ultimately extend to <strong>race</strong> and <strong>sex</strong> <strong>discrimination</strong> cases anywhere a contract is involved.</p>
