Judge Hanen’s Most Recent Decision on DACA

While Texas and other GOP-led states have sought the complete termination of the DACA program, Judge Hanen’s recent decision allows existing DACA recipients to continue renewing their status, at least temporarily. This judicial terror against the undocumented community is being allowed to continue by the Biden administration. Despite likely appealing this ruling to the Fifth Circuit Court of Appeals, which previously ruled against DACA in 2022, the Biden administration faces the prospect of DACA reaching the Supreme Court in 2024–2025. A favorable outcome for DACA at the Supreme Court is laughable. The far-right-controlled Supreme Court has consistently denied progressive concessions benefiting low-income and marginalized communities.
