Making a late claim about discrimination in the employment tribunal

If you have already missed the time limit you can still make a claim about discrimination to an employment tribunal.

A tribunal always has power to grant an extension of time to hear a late claim on the ground that it would be “just and equitable” to do so. The law about this is in section 123(1) of the Equality Act 2010. This gives the tribunal a very wide discretion. It is difficult to give precise guidelines about the sorts of cases likely to succeed.
