A Critical Race Theory Perspective on “Colorblindness” in U.S. Supreme Court Affirmative-Action Decisions: A Sword that Cuts Both Ways
<p>This paper uses Critical Race Theory (CRT) as a framework to examine the relationship between the U.S. Supreme Court’s (the Court) decisions on affirmative action in school admissions and society’s progress toward educational equity. Reviewing the history of the Court’s affirmative-action rulings, the analysis includes the Court’s application of race-neutrality (i.e., colorblindness) in deciding the constitutionality of race-based admission schemes. Synthesizing the Court’s changing position on race-based affirmative action programs, the essay concludes by weighing the relevance for achieving educational equity of the proposition that “Race is a sword that cuts both ways.”</p>
